Grant Of Paid Holiday On Account Of Muncipal Election In West Bengal

Government of West Bengal vide notification No:Labr/75/(LC-IR)/IR/7S-06/17 has grant a paid holiday on 12th February 2022 (Saturday) to all categories of workers and employees of shops, commercial and industrial establishments who are voters in the four municipal corporations constituency area such as Siliguri Municipal Corporation, Chandernagore Municipal Corporation, Bidhannagar Municipal Corporation and Asansol to enable them to exercise their right of franchise in the election. Employer shall take a note and declare paid holiday accordingly.

Grant Of Paid Holiday On Account Of General Election In Uttar Pradesh

Election Commission Of India vide notification no.F. 184/Addl.LC/Holiday-Election/2019/272-278 has declared paid holiday from 10th February 2022 to 07th March 2022 on account of general election in Uttar Pradesh. As per notification, business establishments, establishments, Factories located in Delhi should ensure that the electors residing in of Uttar Pradesh and working in different establishments of NCT of Delhi should be granted paid holiday on the day of poll in the their respective constituency as per schedule annexed as Annexure-A, to enable them to cast their vote. Hence, employers of Industrial Establishments/Factories /Shops and Commercial Establishments in NCT of Delhi shall grant paid holiday to their employees who are electors of Uttar Pradesh to enable them to cast their vote in their respective constituency on the day of polling in case scheduled day is a working day for them or elector.

Grant Of Holiday On Account Of General Election In Uttar Pradesh

Government of Uttar Pradesh vide notification No.3/2022/134/36/-03-2022-02/2014 has declared holiday for employees who are working in shops and establishments on account of general election in Uttar Pradesh on 10.02.2022, 14.02.2022, 20.02.2022, 23.02.2022, 27.02.2022, 03.03.2022, 07.03.2022. Therefore, employers of shops and establishments shall declare election day as holiday if such day not falls under weekly holiday.

Grant Of Paid Holiday On Account Of General Election In Uttar Pradesh

Government of Uttar Pradesh vide notifcation No.2/2022/109/36-03-2022-02/2014 has declared paid holiday for employees who are working in factories on account of general election in Uttar Pradesh on 10.02.2022, 14.02.2022, 20.02.2022, 23.02.2022, 27.02.2022, 03.03.2022, 07.03.2022. As per notification, employers of factories which are non seasonal in nature shall declare public holiday and compensatory off on next day of election as well employers of seasonal factories shall declare day of election as a public holiday.

Rajasthan Grant of Paid Holiday On Account Of General Election In Uttar Pradesh And Punjab

Government of Rajasthan and Election Commission Of India vide notification no. F. 14(13)(1)Election/Labour/2015/Part-1/2669/2591 has declared paid holiday on 10.02.2022, 14.02.2022, 20.02.2022, 23.02.2022, 27.02.2022, 03.03.2022, 07.03.2022 on account of general election in Uttar Pradesh and on 20.02.2022 for general election in Punjab. As per notification, business establishments, establishments, Factories located in all districts of Rajasthan as well areas sharing boundaries with Punjab and Uttar Pradesh should grant paid holiday on the day of poll in the their respective constituency of Uttar Pradesh to enable them to cast their vote. Hence, employers of Industrial Establishments, Factories , Shops and Commercial Establishments located in Rajasthan shall grant paid holiday to their employees who are electors of Uttar Pradesh, Punjab to enable them to cast their vote in their respective constituency. The notification for paid holiday in Uttar Pradesh and Punjab have been appended. The Maharashtra Minimum Wages VDA Notification (Jan 2022)

The government of Maharashtra has released revised minimum rates of wages (variable dearness allowance) effective from 1st January 2022 which will be valid till 30th June 2022

The Contract Labour (Regulation And Abolition) Himachal Pradesh Amendment Act, 2020

Government of Himachal Pradesh vide notification no 01 of 2022 has repealed The Contract Labour (Regulation and Abolition) Himachal Pradesh Amendment Ordinance, 2020 with ordinary legislation to be known as The Contract Labour (Regulation and Abolition) Himachal Pradesh Amendment Act, 2020. As per the amendment the applicability to the Act for the establishments is thirty or more workmen from the earlier twenty or more workmen. Hence Employers in Himachal Pradesh who have engaged the services of contract workers via contractors in their establishment to make note of the amendment and comply accordingly.

Haryana Grant of Paid Holiday On Account Of General Election In Uttar Pradesh And Punjab

The Faridabad Industries Association and others filed a writ petition challenging the implementation of The Haryana State Employment of Local Candidates Act, 2020. The Hon’ble Punjab and Haryana High Court has considered the arguments of both parties and granted an interim stay on implementing The Haryana State Employment of Local Candidates Act, 2020 on 3rd February 2022.The Hon’ble High Court directed to post the matter on 18th of April 2022 and put forward a substantial question of law “Whether any State can restrict employment (even in the Private Sector) on the basis of domicile” Therefore, employers may take a note that interim stay has been granted on implementation of The Haryana State Employment of Local Candidates Act, 2020 until final order.Please refer to the order for more details. Grant Of Paid Holiday On Account Of General Election In Uttarakhand

Government of Uttarakhand vide notification No.698/29/2022 has declared paid holiday in Uttarakhand on 14th February 2022 (Monday) on account of general election for employees who are working in industrial establishments, factories, governing and non governing body, educational institutions, commercial establishments and shops.

Grant Of Paid Holiday On Account Of General Election In Goa

Government of Goa vide notification No.2/2/2010-GAD-III/447 has declared 14th February 2022 as a public holiday being the polling day for the general elections to the Goa Legislative Assembly, 2022 throughout the State of Goa. As per notification, 14th February 2022 also declared as a paid holiday for the establishments as mentioned, (1) Industrial workers of the state of Goa, (2) daily wage workers of the Government Departments and State Government Industrial Departments, (3) commercial and industrial workers of private establishments in the state of Goa, (4) all private establishments, (5) daily wages, casual workers employed in any business, trade industrial undertakings or any other establishments.

Himachal Pradesh Grant Paid Holiday On Account Of General Election In Uttar Pradesh, Uttarakhand, Punjab

Government of Himachal Pradesh vide circular No.1-18/85(Fac)Lab-Vol-II has declared paid holiday for electors of Uttar Pradesh, Uttarkand, Punjab who are employed in business, trade, industrial establisments or any establishments located in Himachal Pradesh on account of general election in Uttar Pradesh on 10.02.2022, 14.02.2022, 20.02.2022, 23.02.2022, 27.02.2022, 03.03.2022, 07.03.2022 and Punjab on 20.02.2022, Uttarakhand on 14th February 2022.

Grant Of Holiday On Account Of General Election In Tamil Nadu

Government of Tamil Nadu vide notification G.O (Ms) No.27 has declared public holiday on 19th February 2022(Saturday) for all Government offices, including industrial establishments of Government and Government controlled bodies and all education institutions.

Conditions On Factories For Female Workers In Jharkhand

Government Of Jharkhand vide notification No.7/1003/2022-113 and pursuing notification released on 3rd February 2017 under Labour, Employment and Training Department has declared conditions on factories which directs working schedules for women workers. As per notification, amended clause 15, 20, 23 of the conditions as mentioned in the earlier notification which requires, (1) Occupier of factory shall not employ less than five women workers under one batch (2) One Female Warden shall be allocated for supervision and helper for welfare work (3) The strength of women in Supervisory Staff shall be one fifth or at least two or more. Circular On Grant Of Paid Holiday For General Election In Tamil Nadu

Government of Tamil Nadu vide Letter No:2779/J1/2022-1 has requested commissioner of labour to direct the employers of all industrial establishments, shops, factories and public sector undertakings to provide holiday with wages to all the labourers under the control on the poll day going to be held on 19th February 2022 in those areas wherever such poll take place. The Kerala Minimum Wages Notification (Dec 2021)

The Government of Kerala, Labour and Skills (E) Department has revised the variable dearness allowance for employment in Shops and Commercial Establishment and employment in Computer Software Sector. As per the Notification No.DES/859/2022-P3(1) , the Consumer Price Index (Cost of Living Index) Numbers applicable to employees in employment under the Minimum Wages Act (Central Act XI of 1948) for the month of December 2021 ascertained by the Director General of Economics & Statistics under clause (C) of Section 2 of the Act

Government of West Bengal vide notification No:Labr/129/(LC-IR)/IR/7S-06/17 has issued instruction to all shops, commercial and industrial establishments, in all areas pertaining to the municipalities to which election has been notified and grant a paid holiday on 27th February 2022 (Sunday) to all categories of workers and employees who are voters on such constituency. The employers may take a note and declare paid holiday accordingly.

Honourable Supreme Court Set Aside Order On The Haryana State Employment of Local Candidates Act, 2020

The Hon’ble Supreme Court of India set aside the stay order of the Punjab And Haryana High Court dated 03rd February 2022 which halted the implementation of the Haryana State Employment Of Local Candidates Act,2020 until such time that the constitutional validity of the legislation is determined. The Supreme court, while setting aside the stay, directed the Punjab and Haryana high court to expedite the hearing and decide on the validity of the law within a month. It is also observed that no coercive action shall be taken against companies that do not comply with the law that mandates seventy five percent reservation for the state’s residents in jobs paying less than thirty thousand a month.

The Government of Karnataka vide notification No.DES/01PWX/38/2021-22 has released the enhanced consumer price index for 2022 for calculating the variable dearness allowance effective 1st-April-2022 to 31-March-2023

Extension Of Shops And Establishments Enactment In Certain Local Areas Of Madhya Pradesh

Government of Madhya Pradesh vide notification No.291-52-2022-A-XVI has extended the application of The Madhya Pradesh Shops And Establishments Act, 1958 in the areas comprised within the local limits of nagar panchayats such as Bilhara, Malthon, Surkhi, Bandri of Sagar district in Madhya Pradesh. 

EPFO Circular On Trainees Under National Employability Enhancement Mission (NEEM)

EPFO vide circular No.Compliance/NEEMscheme/2021 recommended to all additional central provident fund commissioner and Zonal commissioners that provisions towards The Employees Provident Fund And Miscellaneous Provisions Act, 1952 will be applicable for the students getting placement in companies and appointed as employee of the establishments even during job or training or induction and other trainings taken after becoming employee. Therefore, Trainees Under National Employability Enhancement Mission are not exempted from the definition of “employee” under The Employees Provident Fund And Miscellaneous Provisions Act, 1952.
